The Ohio General Assembly in 2004 has passed and the Governor has signed two bills
dealing with 1) medical requirements for filing claims for silica or mixed dust disease - Am.
Sub. H.B. 342; and 2) medical requirements for filing claims for asbestos related diseases - Am.
Sub. H.B. 292. The following information on these bills is available.
Am. Sub. H.B. 292 - Asbestos Related Disease Claims
Establishes minimum medical
requirements for filing certain asbestos claims, to specify
a plaintiff's burden of proof in tort actions involving
exposure to asbestos, to establish premises liability in
relation to asbestos claims, and to prescribe the
requirements for shareholder liability for asbestos claims
under the doctrine of piercing the corporate veil.
Effective September 2, 2004
Am. Sub. H.B. 342 - Silica and Mixed Dust Disease Claims
Establishes minimum medical requirements for filing certain silica claims or mixed dust disease claims, establishes
premises liability in relation to those claims, and prescribes the requirements for shareholder liability for those
